John Doe and Pay up or Else Schemes have been on the rise. Most are the result of entertainment industry using internet IP addresses as the only source of evidence. Most result in a letter demanding money or else legal action will be taken, all done without any legal due process. Lawyers, the public and consumer advocacy groups have compared these practices to extortion.
District Court Judge Harold Baker has denied a copyright holder the right to subpoena the ISPs of alleged copyright infringers, because an IP-address does not equal a person.
So many variables are involved in how IP's work regarding authenticity, this method should be not the sole evidence used in these cases.
We the people request to not be treated like thieves, please require due process in all IP cases.
