This petition is to make Miller v. Alabama retroactive in Louisiana and other states that it is not applied to. This will be applied retroactively to all defendants who received mandatory life imprisonment for homicides as juveniles.
After all, when the Supreme Court held in Roper v. Simmons, 543 U.S. 551 (2005), that the death penalty was unconstitutional for juveniles, there was an immediate end to all executions of juveniles. Likewise, when the court in Graham v. Florida, 130 S. Ct. 2011 (2010), struck down life sentences for juveniles who commit nonhomicide offenses.
