Now that Senate Republicans have made clear that they will never confirm anyone President Obama nominates to the Supreme Court, he has a constitutional duty to make a recess appointment before Congress comes back into session next week. Without a recess appointment, the Court will be deadlocked 4-4 on many vital issues for the next two terms. Such an appointment would clearly be constitutional, as this vacancy arose during a congressional recess. We should not wait to start rolling back Antonin Scalia's disgraceful legacy of support for corporations and gun nuts, and his disdain for social progress. We can begin overturning some of those decisions THIS YEAR with a recess appointment. It's the constitutional thing to do.
