Make a Recess Appointment of a Supreme Court Justice on January 3.

Because Senate Republicans have refused even to consider President Obama’s Supreme Court Justice nominee Merrick Garland, and
Because this sets a dangerous precedent of irresponsible misbehavior and has weakened the traditional constitutional order that protects our rights and safety,
we ask the President to make a recess appointment of the justice of his choice to replace Justice Scalia. The President not only has the constitutional obligation to appoint members of the SCOTUS, he has the Article Two right to appoint a member while the Senate is in recess, which they shall be between annual Congressional Sessions.
