The Republican-controlled senate has made it clear that they will not meet with any Supreme Court candidate, give a hearing to anyone, nor will they vote on any candidate. The president has the legal authority to make a recess appointment at the next available recess after identifying a viable judge to sit on the bench. This will allow the people's choice, President Obama to select the appropriate voice on the bench for the remainder of his term.
