The Innocence Project has, through DNA testing, exonerated over 250 persons wrongly accused and imprisoned for serious offenses. Prosecutorial misconduct is oftentimes the prevailing factor that results in innocently accused people being sent to prison. There are no set repercussions for willful and deliberate prosecutorial misconduct. If willful and deliberate prosecutorial misconduct is deemed a felony, then the number of innocently accused people being sent to serve prison terms should significantly decrease since prosecutors who might be tempted to purposely withhold information, and the like, will know that they, themselves, could be charged with a felony if they do so.
