Section 1 of the 14th Amendment states that everyone born / naturalized in the United States is a citizen and no State shall enforce any law which shall abridge the privileges or immunities of citizens. Also this amendment states that a State can not deny to any person within its jurisdiction equal protection under the laws. So by creating a drinking / smoking age you are directly discriminating aganist subgroup of 18-20 year old citizens (which are apparently old enough to enlist in the armed forces and vote, but not enough to drink) which should have equal privileges under the law, but do not. How is this constitutional?
