Modify the Uniformed Services Former Spouse Act: Once a former spouse remarries, they are no longer entitled to payment.

Created by H.C. on December 22, 2011

Once a former spouse of a military veteran remarries, the former spouse will no longer be entitled to receive up to 50% of the veterans retirement pay.
The Uniformed Services Former Spouse Protection Act (USFSPA) was established in 1982. The entitlement is decided by the State to determine the appropriate division of retirement pay; the veterans’ retirement pay is considered "marital property" at the time of separation. This is very similar to alimony with the exception of once the former spouse remarries, they continue to receive the veteran’s retirement pay. If the household income of the former spouse exceeds that of the veteran, the former spouse continues to receive pay; the former spouse's current spouse reaps the benefit of the veteran.
