National Guard Soldiers are currently unable to obtain VA Compensation for Title-32 injuries. This means that any National Guard (or Reserve) soldier that is injured during their mandatory drill period at their unit cannot receive a disability rating from the VA for this injury. Active Duty soldiers simply need to provide the Line of Duty paperwork and medical records to receive these benefits. Even if the soldier already receives compensation for an existing injury from Active Duty, subsequent claims for injuries stemming from National Guard duties will not be treated or compensated. This VA policy essentially states that National Guardsmen are not Veterans. That they are not soldiers. That they are not entitled to medical care. Please pass a law to give Guardsmen equal rights.
