In 2005, Ruth Bader Ginsburg cited the "doctrine of discovery" in City of Sherrill v. Oneida Nation of New York. In 1978, the SCOTUS eroded tribal sovereignty with Oliphant vs Suquamish leading to tribes being unable to prosecute non-Indian criminals on tribal lands. This lead to open season on American Indian women and children. American Indian women and girls are raped at the highest rates in this country with over 80% of the perpetrators being non-Indian.
