Under the Preamble of the Constitution, the first three words are "We The People". Therefore, the Supreme Court should not have the power to declare items that have been voted on by the public "unconstitutional". The only way to overturn such items would be by another public vote repealing it. Since We are governed by Popular Sovereignty, if the People decide on a law or act, said law or act would be "constitutional" because the People directly decided on it. The system of checks and balances should only be for the 3 branches of government, not the People, themselves.
