Order the ATF replace the CLEO certificate requirement of the proposed rule making in Notice No. 41P with a NICS check.

This petition is a request that the administration advocate for the removal of the CLEO certificate requirement outlined in the proposed rule making in ATF Notice No. 41P and replace it with a process that would include a NICS check for the principal officers of any Trust or Corporation that may receive any NFA Registered Firearms. The ATF will already require that fingerprints be submitted to the FBI in that proposal, and also routinely checks the NICS system, as well as the NLET System, and the III system. The current proposal allows for interference at a local level from CLEO's whom may have an unconstitutional view on the use of these NFA registered weapons. Furthermore, the ATF no longer accepts the CLEO certificate as prima facie verification of compliance with state and local law.
