President Obama: order DOJ – before the Electoral College meets on Dec. 19 – to bring an emergency petition asking the Supreme Court, under its Article III, Section 2[2] original jurisdiction, to enjoin the officers of 29 states and District of Columbia from enforcing all statutes commanding electors on pain of punishment/replacement to act as rubber stamps when voting, and to declare such restrictions in violation of Article II, Section 1[3], as modified by Amendment 12, and the 1st Amendment. The constitution’s drafters intended electors to exercise independent judgment. As the proponent of the Electoral College Alexander Hamilton wrote in Federalist No. 68, electors were meant to prevent unqualified, unfit demagogues, or persons under foreign influence/control from becoming president.
