By the terms of Title II of the Communications Act of 1934 Section 230 it is the policy of the United States to "promote the continued development of the Internet and
other interactive computer services and other interactive media;" and to "preserve the vibrant and competitive free market that
presently exists for the Internet and other interactive
computer services". The decision reached by the US Court of Appeals for the District of Columbia in the case of Verizon v. Federal Communications Commission has effectively ignored current US policy. Reclassifying ISPs as common carriers would give the FCC the ability to enforce current the US policy as established by the 1996 Telecommunications Act in an easier and more direct fashion.
