Order the state of Kansas to recognize its own Constitution and the rights of its disabled citizens.

The state of Kansas is in violation of its own Constitution, in reference to disabled Kansans receiving Home & Community Based Services (HCBS). The Constitution clearly states that disabled individuals have the same rights as all Kansans and in particular, they have the right to choose where to live. Because of the constraints placed upon recipients of HCBS and its "client obligation," disabled Kansans cannot afford to live where they choose and in most cases, cannot even afford the basic necessities in life. The protected income level for HCBS recipients is less than $800 a month and has not been adjusted for cost of living increases since the late 1990's. Lawmakers in Topeka ignore the facts of poverty stricken, disabled Kansans, in favor of lobby groups for the nursing home industry.
