On October 26th, 2012 in the state of Kansas Judge Kevin Moriarty awardeded Complete Nutrition $36,000 for damages due to defamation. The defamation was due to doing a price comparison of a product, a common practice in business. Due to the technicallity of listing Complete Nutrition's every day price vs. their sale price, judgement was found in favor for the plaintiff. This petition is to overturn that judgement and dismiss the case for respect to consumer rights and freedom of speech in publicizing factually quoted information, as Complete Nutrition has caused a burden to small business owners across the country who do not have the means or resources to properly defend themselves in a court of law; and simply use this as a tactic to put competitors out of business.
