The proposed Anti-Financial Victimization Act will provide consumer protection to abondoned, innocent and disserted spouses by law under the Fair Debt Collection Practices Act (FDCPA), 15 U.S.C. § 1692 et seq and Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq, when it has been established the irresponsible and negligent financial behavior of their respective spouse resulted in adverse credit collection and reporting. Corporate America limited liability and the IRS “Innocent Spouse Relief” (IRS Publication 971) provide a level of consumer protection but their are no laws pertaining to maritial joint accounts and marital debt. Many spouses have been victimized and continue to suffer post-divorce. The AFV Act can empower the courts to order remedy of such cases via court order.
