Pass legislation to keep our veteran's VA disability benefits from going to ex-spouses after a divorce.

Created by M.H. on December 22, 2011

VA Disability benefits, which were earned by the sacrifice of our veterans, are held hostage in divorces. These benefits are considered income for purposes of maintenance and child support, when in fact there is a specific portion of said benefits set aside for the support of children and a spouse. The result is that a disabled veteran's benefits end up working against him/her and going to a person who shouldn't receive them - a former spouse who is not disabled. Legislation should be passed specifically exempting the veteran's portion of their VA disability benefits from being considered income for purposes of spousal maintenance and child support. Only the additional benefits specifically provided for support of children should be considered as income.
