We request investigators from the Employment Standards Administration's Wage and Hour Division conduct investigations of full service restaurant and fast food establishments to determine the level of compliance with the Fair Labor Standards Act (the FLSA).

The industry includes establishments which are primarily engaged in selling and serving to purchasers prepared food and beverages for consumption on or off the premises.

Tips may be considered as part of wages, but the employer must pay not less than $2.13 an hour in direct wages and make sure that the amount of tips received is enough to meet the remainder of the minimum wage.

We the petitioners believe the restaurant/fast food industries are not complying with the FLSA,over 4,110,400 workers are not paid a living wage.
