1. Emergency situation the VA will accept the word of the Veteran they are eligible for care.
2. Non-emergent care the Veteran shall be deemed eligible within 72 hours of application.
3. Denial of coverage shall be the responsibility of the VA to prove the Veteran is not eligible for coverage. In the absence of proof the VA shall determine the Veteran is eligible for coverage as the VA and the Military is the keeper of the official records. The VA will have 6 months to prove the Veteran is not eligible and no penalty, after which the VA shall not be able to refuse treatment.
The VA and the Military are the keeper of the records and the burden of proof is on the VA and/or the Military to prove the Veteran is not eligible for care.
