The basis of this rule itself is unconstitutional. The rule was made to "protect" traders from the high risk of day trading. The traders that are affected by this rule are those who have brokerage accounts of less than $25,000, because these traders are considered less sophisticated by congress. This rule denies a new trader's right to invest his money how he/she wishes to do so. Overall this rule creates more risk and limits traders' rights and it is a shame that it has been kept for almost 16 years.
