Posthumously impeach President Lincoln for his unlawful and unconstitutional suspension of habeas corpus in Maryland.

Created by R.H. on November 28, 2012

I firmly believe that the Worst Crime a democratic Government can commit against Her People is the Declaration of Martial Law, and the Suspension of the Writ of Habeas Corpus.

While the Constitution does allow for these actions "in cases of Rebellion," this is a Responsibility allocated to Congress, not the President.

As ruled in the case 'Ex parte Merryman,' Lincoln's Suspention of Habeas Corpus was, in fact, Unconstitutional. Lincoln, and his army under him, Knowingly and Intentionally ignored the ruling of Supreme Court Chief Justice Roger Taney, and Declared Martial Law and Suspended Habeas Corpus in Maryland, regardless.

I move for a Senate vote to symbolically Impeaching the president for Blatantly ignoring the Constitution he pledged his Sacred Honor to protect.
