Preserve Constitutional Rights to Property and Freedom for Incapacitated Elders. Guardians have too much power.

In all 50 states, the legal system is being misused to strip elders of their freedom and assets. If an elder can be deemed incapacitated, court-appointees can submit enormous ongoing fees to be paid out of the elder's estate, draining it completely. Anyone can petition to become a guardian over an elder. The 2010 Government Accountability Office report exposed many abuses, especially financial exploitation and forced incarceration in nursing homes. Guardians control where the elder can live, and who can visit. Often families are prevented from seeing the ward once they have complained about the situation. The system is ripe for abuse, it is not properly monitored or regulated, and the severity of abuses to the elderly is great. Please put a stop this. Thank You.
