The Senate has lost its right to advise and consent to the nomination of Merrick Garland by failing to act in a timely manner. Federal courts, including the Supreme Court, have held that a right, if not exercised in a reasonable amount of time, can be forfeited. No other Senate in the history of the United States has waited this long to act on a Supreme Court nomination, and Merrick Garland's qualifications are not in question.
We therefore call on President Obama to exercise his Constitutional duty to appoint Justice Garland to the Supreme Court.
