It is one thing to charge a cell phone customer a fee when that customer chooses to send a text message (even if those charges are outrageous), but users should not be forced to pay every time somebody else, over whom they have no control, sends them a text message. There is legislation trying to stop unwanted commercial or spam texts, but that doesn't stop your friends and family or clients and co-workers from racking up charges on your account. As an example, the ONLY way to avoid charges to receive text messages on AT&T's network is to opt out of text messaging altogether. This prevents you from ever sending a text message and even disables the iPhone's iMessage capability. Customers should pay for services they choose to use, but should not be punished for the acts of third parties.
