This petition calls for a constitutional amendment to create a check on the Supreme Court's de facto power to legislate via proclamation and via a self-ascribed power of final judicial review. No decision of government should be immutable by the other branches or by the people yet there is no practical check to the Supreme Court's powers of constitutional interpretation. The Framers never intended unchecked powers for any branch and most likely did not anticipate a unilateral assumption of such power by the judiciary nor the acquiescence of the other branches to such assumption of unmitigated power. The proposed amendment would give Congress and the President power to nullify a Supreme Court decision deemed to be based upon a gross misinterpretation of a clear meaning of the Constitution.
