These treats are legal and widely sold in Europe, Canada, and the Pacific.
The FDA has banned this product out of the idea that the toys it contains are unsafe. However, they are enclosed in large plastic capsules that are much harder to swallow than lollipop sticks. There have only been two recorded deaths from choking on these toys, and both happened several days after consumption - eating the chocolate did not cause them.
