Fact: A consular officer’s decision to deny a visa is almost never reversed.
Reason: The Department of State does not provide a formal and binding appeal process.
Current option: The only option is to seek an advisory opinion from the DOS. The DOS will sometimes reverse a consular officer's decision if an officer misinterprets the law. but almost never If the officer’s decision is based on the officer’s "opinion" about whether the applicant will return after the visit.
Why it needs to change: The US democracy has always relied on the balance of power. Leaving this critical decision up to an individual, without a formal appeal process leaves open the possibility of incorrect or even illegal interpretation of the law and deprives people of justice.
