Since the Senate has failed to fulfill its constitutional role to advise the President on judicial appointments, and specifically the nomination of Merrick Garland to the Supreme Court, President Obama should proceed with a recess appointment. The Senate has failed to advise, the President should fulfill his constitutional duty to Fill Supreme Court vacancies.
