Under the terms of the Universal Declaration of Human Rights, the International Covenant on Economic, Social and Cultural Rights, the International Covenant on Civil and Political Rights,We invoke Article 37 (“Indigenous peoples have the right to the recognition, observance and enforcement of treaties”) of The UN Declaration.
The provisions in the Declaration that acknowledge tribes’ rights to self-governance, to manage their own lands and resources, and to protect their subsistence economic activities, and that prohibit discrimination against tribes and their members.
Article 40 says that disputes that tribes have with countries about treaties or other matters must be resolved through just and fair procedures.
