Recognize involuntary resignation (constructive discharge) under the law and outlaw this popular employer loophole.

Created by J.D. on January 04, 2013

Many Americans are treated poorly, harassed, degraded, and punished everyday in an effort by employers when just cause isn't an option to terminate employment and to avoid the hassle of unemployment claims. By making someone's job so miserable that a reasonable person would rather quit than continue being mistreated, the employer stands to avoid legal recourse against them by claiming the employee just quit. Although the Supreme Court recognized this practice, it isn't even recognized in employment law and through the recession it has become popular due to it turning every employee into a temporary one, thus keeping wages suppressed and everyone on their toes.
There are proper ways to improve employee performance or remove employees for just cause without this cruel practice.
