LGBT Families exist without the protection of law in many states in the United States. As a class, children of LGBT families are discriminated against and denied the benefits of legal recognition of the parental status, with the rights and responsibilities pertaining to that status of both of their parents. Often the biological parent (in lesbian couples) abuses her legal power over the child when the couple separates, against the best interests of the child. Litigation is often too expensive for the non-biological parent, and she must "give up", knowing that she can not prevail when the biological parent has an unfair advantage in the legal system. Nonetheless, the child has a right to the love and support of both her parents especially when that child is conceived in a 2 parent family.
