The willful and intentional murder of a 13-month-old white infant in Georgia by two black males falls under the federal guidelines in determining a hate crime. 17-year-old De’Marquise Elkins and his 14-year-old accomplice should both be tried as adults and subject to the death penalty for the capital murder of 13-month-old Antonio Santiago and the attempted murder of his mother SHerry West. This crime should not be pursued at teh state level, instead it should be made intoa federal case where the death penalty is the only punishment available.
