The 9th Circuit is too large to properly administer justice. Justices Anthony Kennedy and Clarence Thomas of the Supreme Court have even stated that the 9th Circuit is too large and unwieldly and needs to split.
We proposed reforming the 8th, 9th, and 10th Circuits and establishing a new 12th Circuit as follows:
8th Circuit: Transfer the States of Kansas and Oklahoma from the 10th to the 8th Circuit.
9th Circuit: The 9th Circuit would include the States of California, Hawaii, and Nevada, as well as Guam, the Northern Mariana Islands, and American Samoa.
10th Circuit: The 10th Circuit would include the States of Arizona, Colorado, New Mexico, and Utah.
New 12th Circuit: The 12th Circuit would include the States of Alaska, Idaho, Montana, Oregon, Washington, and Wyoming.
