Under the current Affordable Care Act (ACA), uninsured spouses of insured workers are not eligible for subsidies to purchase insurance, even when the insurance offered by their partner's employer does not meet the act's standard for affordability. Many companies do not provide similar cost-matching for spouses. Thus, the ACA as implemented is discriminatory on the basis of marital status. e.g. Two healthy 30-yr old people, each making $21,000/yr, are each entitled to receive subsidies under the act, and will pay only about $100/mo each, but if these same two marry, and only one receives an employer offer of $150/mo coverage, they will have to pay the full cost of individual coverage for the other, let's say $220/mo, or have to pay a tax penalty.
