Civil Asset Forfeiture cannot exist in its current state as it is a violation of the constitutional rights granted for due process. Due process is intended to protect the citizens of the United States from the Government arbitrarily seizing property without reason, however, in its implemented form Civil Asset Forfeiture has been shown to have no regard for the rights of the citizens it affects and allows for property to be seized with no reason other than suspicion. The burden of proof is placed on the individual to prove their innocence and to receive their property back, which is in violation of innocence until proven guilty. For these reasons, Civil Asset Forfeiture must be reformed to better reflect the interests of the individuals in which it affects.
