Title 5, United States Code, Section 1208 (5 USC 1208), currently "gives eligible veterans preference in appointment over many other applicants." Applicants may be granted 5 points if they have more than 180 consecutive days of active duty or 10 points if they have a service related disability or are Purple Heart recipients. Under the current legislation, service members who have faithfully served reserve or national guard contracts but have not been called to active duty for more than 180 consecutive days do not receive this benefit. All service members sign a legal commitment to deploy world wide in support of defense operations. When they are called up, it is not a choice. All members who have completed one full contract should receive this benefit for the commitment they honored.
