Uniformed Services Former Spouses Protection Act (USFSPA), 10 U.S. CODE § 1408 allows former spouses to receive up to 50% of the retired service members military retirement. This Act allows former spouses regardless of how long they have been married to the military member to receive the portion of military retirement benefit for LIFE. Many former spouses are remarried and still receiving portion of this military retirement for life.
This Act needs to be reformed to state that any former spouse who remarry are ineligible for lifetime benefits. Former spouses who have been married to the military member for 15 to 20 years or more should be the only ones eligible for lifetime benefits.
