Marlise Munoz was put on a ventilator after being declared brain dead against her wishes, according to her husband, because Texas Health and Safety Code Sec. 166.049. states "A person may not withdraw or withhold life-sustaining treatment under this subchapter from a pregnant patient."
The hospital she was in had interpreted this law to include brain dead patients, who are legally dead according the the federal Uniform Determination of Death Act. In addition, the Munoz family would've been within their rights to terminate the pregnancy had Mr. Munroz's wife been alive.
This practice, which can have serious effects on fetal viability, is legal in 26 states. Let's change that
