Recently in Pennsylvania, the Defense of Marriage Act was struck down by a federal judge on the grounds that it was unconstitutional because it violated the 5th amendment of the Constitution. This, however, is not true. The 5th amendment is specifically aimed at rights of the accused and DOMA does not affect the rights of the accused. Therefore, the unconstitutional label does not apply to DOMA. We would like to petition the Obama Administration to restore DOMA in Pennslyvania and to allow for the state to decide when to repeal DOMA, rather than the federal government. If the decision to repeal DOMA is a states rights decision, then the state should be allowed to make it.
