to release DZHOKHAR TSARNAEV based on of false testimony because he wasnt given his constitutional rights at his arrest

i believe the Obama government should release DZHOKHAR TSARNAEV based on the grounds that he wasnt given his constitutional rights at his arrest and before they questioned him ,the constitution states that ,at arrest he should have been given his miranda rights -then start questioning ,its a crime based on the constitution to question a suspect even after arrest with out miranda rights
