Under current Federal regulations, marijuana testing practices for DOT regulated organizations require the use of tests for THC-COOH, a long-lived metabolite than can be detected in regular users for up to ten days after last use at current cutoffs, and in one-time or infrequent users for up to five days. This in no way establishes impairment for workers covered under the regulation.
We the People believe that the current regulation violates the spirit of the Act, which exists to protect the public, and the protection under the Fourth Amendment against unreasonable search. We believe that the Administration should cease tests for this metabolite and establish a test for impairment such as exists for alcohol, a drug regarded even by the President as more dangerous.
