Repeal section 3(m) and mandate restaurants pay servers minimum wage. The restaurant industry lobbies to maintain a tipping system so it can pay servers just $2.13/hr & doesn't have to pay employees the same minimum wage that every other business must pay. We are subsidizing their minimum wage. The tipping system is poor for customers & servers alike and only helps restaurants maintain low overhead. Cultural expectations of tipping as the primary source of workers' incomes allow owners to make workers subsist on bare minimums while the owners still make money without paying workers a real wage. Make restaurants responsible for paying servers the federal minimum wage. Costs will be passed on to customers, but it relieves servers of the life-and-death control we have over their livelihoods.
