Repeal 42 USC 1396(p) which gives States a free hand in forcing the sale of family homes

Created by L.P. on December 04, 2012

The Medicaid Recovery Act put in place by the Bush administration gives States a free hand in forcing the sale of family homes in order to recover Medicaid expenses incurred by elderly persons. The statute, as written, is vague as to the methods the States may use and to the avenues available to the families for appeal. As a result, many States are abusing this power and denying any type of appeal to families trying to save homes that they've owned for generations.
