The Animal Enterprise Terrorism Act of 2006 violates the First Amendment of the Constitution of the United States by criminalizing protest and inflating punishment to crimes such as vandalism to the charge of domestic terrorism, if those crimes are deemed to be in the name of animal rights. This easily fits into the definition of cruel and unusual punishment, which is made illegal in the Constitution's Eighth Amendment, as elevating punishment due to intent from a misdemeanor to a felony is unnecessary.
