Repeal the exception that allowed for questioning Dzhokhar Tsarnaev without counsel present, and without Mirandizing him

Created by C.J. on April 22, 2013

I hope that others feel as I do about this. To allow a citizen of this country, regardless of his crimes, to be denied legal counsel is a gross breech of the sixth amendment.

While I understand that there are instances where time will not allow for it, that simply cannot be argued to be the case in this instance. The man was already hospitalized, and more than that he was intubated, and unable to be questioned effectively anyways. Yet his right to counsel is still denied him? This is a loophole that is being abused and should, therefor, be closed.

Our constitutional rights should not bend at the whim of what is most convenient.
