The Professional and Amateur Sports Protection Act of 1992 effectively banned states and licensed persons from conducting sports betting nationwide. Four states (Delaware, Montana, Nevada, Oregon) were granted grandfather clauses, allowing them to continue operating previously established sports betting institutions. The legislatures of several states, led by New Jersey, have recently called for repeal of the federal ban on sports betting. The right to determine and regulate the status of sports betting should be returned to the states via repeal of the 1992 statute.
