The National Childhood Vaccine Injury Act of 1986 is fatally flawed and should be repealed. Parents are wondering whether it would be better to return to civil court with no restrictions to sue vaccine manufacturers for injuries and deaths their children suffered after receiving mandatory vaccines. Since 1988, over 17,095 petitions have been filed. Over that time period, 14,662 petitions have been adjudicated, with 4,747 compensable, while 9,915 were dismissed. Total compensation paid has been approximately $3.4 billion. Today, nearly 5,000 vaccine injury claims are sitting in limbo because they represent children who suffered brain and immune system dysfunction after vaccination but have been diagnosed with regressive autism, which is not recognized by the program as a compensable event.
