The Copyright Act of 1909 and it's subsequent amendments provided for the sharing of information in the public interest and the graceful termination of the copyright holders rights after a set amount of time.
The DMCA specifically forbids rights granted under the previous legislation and is technically unconstitutional having two existing laws which contradict one another.
Either satisfy the people or satisfy Hollywood and stop riding the middle of the road.
