The Twelfth Amendment calls for the Electoral College to determine the winner of Presidential elections. Swing states such as California and Florida have an unfair advantage in elections by the winner-takes-all foundation of this system.
Electoral College voting is unconstitutional in the sense that if a president wins the overall vote, they may still lose. This government is for the people, and if the people overall favor one president, he/she should be elected.
